Florida 3-Day Notice for Unpaid Rent: How the Days Are Counted

If rent is unpaid, the tenant has 3 days after delivery of the written demand, not counting Saturdays, Sundays or court-observed legal holidays, before the landlord may terminate (Fla. Stat. § 83.56(3)). Email delivery works only with the signed § 83.505 addendum, and taking partial rent after the notice triggers three options in § 83.56(5)(a).

How we pick and check each rule

  • We read the current statute on the Florida Senate website (flsenate.gov), not a summary.
  • We cite the section and subsection, and show the date we checked it.
  • If the statute leaves something open, we say so instead of guessing.
